A claim of negligence in a personal injury or wrongful death case is based on the premise that the defendant breached a duty of care owed to the plaintiff, and that breach caused the plaintiff’s injuries. The first element that must be proven in a negligence case is the existence of a duty. Once established, it must next be shown that the duty was somehow breached. In general, this means that the defendant acted or failed to act below the standard of care which was expected.
