What Causes Vehicle Accidents
2009 New York State DMV data shows 314,974 motor vehicle accidents, including over 1,000 fatalities and over 100,000 injury accidents. Of those killed, over half were drivers, while the rest were passengers, pedestrians and bicyclists. Of the quarter million-plus accidents investigated by the police, one-fifth of those accidents – over 50,000 – were investigated by New York City Police (NYPD). The vast majority of accidents were attributed to human factors; inattention and distraction chief among them. Other major human factors included following too closely, failure to yield the right of way, speeding, and running stop lights or stop signs. Over 10,000 accidents were attributed to vehicle defects and failures, with defective brakes and tire failures being the main causes of accidents. For thousands more accidents, roadway and infrastructure faults were to blame, including obstructed views, defective pavement, and improper or inadequate lane marking.
Lawsuits for “Serious” Injuries
New York has a no-fault system of insurance designed to compensate persons for the basic economic damages sustained in a vehicle accident. So long as you file a timely claim with the proper insurance company, you should be able to recover a certain amount for medical expenses and lost wages. However, it is important that you know what coverage applies and that you follow the proper timelines and procedures, or you may find yourself out of luck for even this basic level of compensation.
In the event that you are seriously injured, the law allows you to also sue the other driver for your damages in excess of what the no-fault system pays. Keep in mind, however, that New York law defines what constitutes a “serious injury,” and it may not be what you would expect. Vehicle accidents can indeed cause very serious injuries, including fractures, amputations, and internal injuries, traumatic brain injury (TBI) and spinal cord injury (whiplash) from front-end or rear-end collisions, or TBI or spinal injury from a rollover and roof crush, as well as burn injuries from fuel fires and explosions.
If you have been injured in a vehicle accident, you should consult with an experienced trial attorney who has handled personal injury and wrongful death cases arising out of vehicle accidents. An experienced lawyer will be able to advise you on the proper insurance claims to file and whether or not a civil lawsuit should be pursued. In New York City, contact Leandros A.
