Who Is Eligible for the 9/11 Victim Compensation Fund?
The events of September 11, 2001, have left an indelible mark on our nation’s history and have had devastating, long-term impacts on the lives of countless individuals. At the New York personal injury law firm of Leandros A. Vrionedes, P.C., we are dedicated to helping those affected by this tragedy understand their legal rights and navigate their eligibility for the 9/11 Victim Compensation Fund (VCF).
The VCF was established by the U.S. government to provide compensation for any individual (or a personal representative of a deceased individual) who suffered physical harm or was killed as a result of the terrorist attacks on September 11, 2001, or the debris removal efforts that took place in the immediate aftermath.
To be eligible for the VCF, an individual must fall into one of the following categories:
First Responders
This includes firefighters, police officers, and other emergency personnel who were involved in rescue, recovery, and cleanup efforts at the affected sites in New York City, the Pentagon, and Shanksville, PA.
Individuals Present at Crash Sites
Individuals who were present at the World Trade Center, Pentagon, or Shanksville, PA, crash site at the time of the attacks or in the immediate aftermath (up until May 30, 2002) are eligible.
Residents and Workers in the Designated Exposure Zone
Individuals who lived, worked, or attended school in the Lower Manhattan area (south of Canal Street) during the specified period are eligible. This “Designated Exposure Zone” is specifically delineated due to the significant dust, debris, and associated toxins released by the 9/11 attacks, which covered this area and posed a risk to health and wellbeing.
The crucial time frame for exposure is from September 11, 2001, to May 30, 2002. It is during this period that the risks from airborne toxins were highest due to the collapse of the Twin Towers and the subsequent cleanup efforts. Claims for compensation from the VCF must demonstrate the presence of the individual within the Designated Exposure Zone during this specific time frame.
The Designated Exposure Zone isn’t limited to the outdoors; it also includes buildings or portions of buildings that were destroyed or damaged as a result of the 9/11 attacks. Individuals who were present in these buildings during or after the attacks, whether as residents, workers, students, or first responders, are included in this coverage.
Relatives of Deceased Victims
If an individual was killed as a result of the 9/11 attacks or the subsequent debris removal, their personal representative can file a claim with the VCF.
Eligibility also requires that the individual have a physical health condition that is approved by the World Trade Center (WTC) Health Program and is linked to the 9/11 attacks. These conditions include, but are not limited to, various types of cancers, respiratory diseases, and musculoskeletal disorders.
